These Terms of Service describe basic rules for using the Ninth Studio website. Project-specific services are governed by the proposal or written agreement accepted by the parties.
1. Using this website
You may use this website for lawful purposes and to learn about our services. You must not misuse the website, attempt unauthorised access, disrupt its operation or submit unlawful, misleading or harmful material.
2. Our services
We may provide website design and development, Shopify services, branding, digital design, SEO, content, marketing and automation services. The exact deliverables, schedule, fees, responsibilities and acceptance process for a project will be agreed in a proposal or written agreement before work begins.
3. Enquiries and project agreements
Sending an enquiry does not create a client relationship or guarantee availability. Work begins only after scope, fees and other material terms have been agreed. You are responsible for ensuring that information and materials you supply are accurate and that you have the rights needed for us to use them.
4. Intellectual property
Unless a written agreement says otherwise, each party retains rights to materials it owned before a project. Ownership, licences and transfer of rights in project deliverables will be set out in the relevant agreement and may depend on payment in full. Third-party fonts, themes, apps, images and software remain subject to their own licences.
5. Third-party platforms and outcomes
Websites and stores may rely on third-party platforms and services that we do not control. We cannot guarantee uninterrupted operation or specific search rankings, traffic, sales, leads or revenue. Any targets or forecasts must be treated according to the terms expressly agreed for the project.
6. Liability and changes
To the extent permitted by applicable law, neither party will be responsible for indirect or consequential loss arising from use of this website. Nothing in these terms excludes liability that cannot legally be excluded. We may update these website terms from time to time; project-specific agreements continue to govern the work they cover.
